• Tracking: You will receive a shipment confirmation email with a DHL tracking number as soon as your order is dispatched. Please allow 24 hours for the tracking status to update.

4. Customs, Duties, and Taxes (DAP)
Gündem ships on a DAP (Delivered At Place) basis. This means:

• Buyer Responsibility: Customs clearance, import duties, and local taxes are the sole responsibility of the buyer.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL Gündem, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Gündem, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SECTION 18 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where Gündem is headquartered. You and Gündem consent to venue and personal jurisdiction in such courts.

At Gündem, we curate high-quality clothing and accessories for a global community. To maintain our competitive pricing and reduce our carbon footprint, we operate with a strict return policy. Please read the following terms carefully before making a purchase.

1. Final Sale & Non-Returnable Items The following items are strictly, as mentioned on the product pages, non-returnable, non-exchangeable, and non-refundable unless they arrive damaged:

• Handmade ashtrays.
  
• Paper clips.
  

2. Return Window
For all eligible items (those not listed in Section 1), the return process must be initiated within the following timeframes:

• EU/UK Customers: You have a statutory right to a 14-day "cooling off" period from the date of delivery to notify us of a return.
  
• All Other Regions (Global): Returns must be initiated within 7 days of the delivery date. Items must be postmarked or handed to the carrier within this window to be eligible.
  

3. Conditions for Return
To be eligible for a return or store credit, items must meet the following criteria:

• Must be unworn, unwashed, and in original condition.
  
• Must have all original tags (hang tag, neck tag, and care label) attached and intact.
  
• Must be free from odors (perfume, smoke), make-up stains, or pet hair.
  
• Items must be returned in their original packaging.
  

We reserve the right to refuse a return if the item does not meet these conditions. Refused returns will be sent back to the customer at their expense.

4. Shipping & Costs

• Return Shipping: The customer is responsible for all return shipping costs and notifying us via e-mail. We strongly recommend using a trackable shipping service and purchasing shipping insurance. Gündem is not responsible for items lost or damaged in transit back to us.
  
• Original Shipping: Original shipping fees are non-refundable (except for EU/UK orders returned within the mandatory 14-day window).
  
• Restocking Fee: We currently do not charge a restocking fee and are doing our best to keep it that way to support our community.
  

5. Exchanges
To maintain efficient inventory levels and a lower carbon footprint, we do not offer direct exchanges. If you require a different size or color, please return your original item (if eligible) for a refund and place a new order for the desired item.

6. Damaged or Faulty Items
If you receive an item that is damaged, defective, or incorrect, please contact us at hello@gundem.cc within 48 hours of delivery. Please include your order number and clear photos of the issue so we can resolve it for you immediately.

7. Global Legal Disclaimer
This policy does not affect your statutory rights. For customers in Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For customers in the EU/UK, our policy complies with the Consumer Rights Directive regarding your right of withdrawal for eligible goods.

Sitemizden alışverişlerinizde, her işlem sırasında göreceğiniz sipariş ön bilgilendirme formu-mesafeli satış sözleşmesi şartları da geçerli olacaktır.

Tüketicinin Ürün'ü teslim aldığı tarihten itibaren 14 gün içinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin siparişten ve Mesafeli Satış Sözleşmesi'nden cayma hakkı vardır. Ancak şu mal/hizmetlere ilişkin sözleşmelerde, kullanılmamış/istifade edilmemiş olsalar dahi, kanunen cayma hakkı yoktur:  

a) Tüketici'nin özel istekleri veya onun kişisel ihtiyaçları doğrultusunda hazırlanan mallar (üzerinde değişiklik/ilaveler yapılarak kişiye/kişisel ihtiyaçlara özel hale getirilenler, Alıcı siparişine istinaden yurt içinden veya dışından ithal/temin edilen özel Ürünler dahil)

b) Kozmetik vb.leri ile çikolata vb. gıda maddeleri gibi çabuk bozulabilen veya son kullanma tarihi geçebilecek mallar

c) Kozmetik, mayo, iç giyim mamülleri vb. teslimden sonra ambalaj, bant, mühür, paket gibi koruyucu unsurları açılmış ve iadesi sağlık-hijyen açısından uygun olmayan mallar

d) Genel olarak ilgili mevzuat uyarınca mesafeli satış kapsamı dışında kabul edilen diğer mal-hizmetler

e) Alıcı'nın ticari/mesleki amaçla satın alma yaptığı haller.

Kanunen cayma hakkı olan hallerde, cayma süresi içinde mal, işleyişine, teknik özelliklerine ve kullanım talimatlarına uygun bir şekilde kullanılmadığı için meydana gelen değişiklik ve bozulmalardan kanun gereği Tüketici sorumlu olup bu sebeple Ürün'e ilişkin cayma hakkını kaybedebileceği gibi, ihtiyaren kabul ettiğimiz takdirde Ürün bedelinden değişiklik / bozulma kadar indirim yapmak hakkımız vardır. Cayma halinde ilgili Ürün'ün en geç yasal süresi içerisinde geri gönderilmesi zorunludur; anlaşmalı kargo firmamız olan Yurtiçi Kargo’nun şubesinden tarafımıza ücretsiz bir şekilde gönderilmesi gerekmektedir ve mümkündür. Cayma hususundaki açık bildirim iletişim adreslerimize mektup, elektronik posta, gibi araçlar ile yapılabilir. Bu hakkın kullanılması halinde, anılan bildirimin yanı sıra Ürün'ün tarafımıza gönderildiğine ilişkin kargo teslim tutanağı örneği ile (vergi mevzuatı uyarınca) irsaliye/fatura aslının iadesi, faturası kurumlar adına düzenlenen Ürün iadelerinde iade faturası kesilmesi, ayrıca iade edilecek Ürün'lerin kutusu, ambalajı, varsa standart aksesuarları ile birlikte eksiksiz ve hasarsız olarak tarafımıza iletilmesi gerekmektedir. Kanunen cayma hakkı öngörülmemiş hallerde cayma hakkından faydalanılamayacağı gibi bu hakkın usulüne uygun veya zamanında kullanılmadığı durumlarda Tüketici cayma hakkını kaybeder. Yukarıda belirtilen gereklerin Tüketici tarafından süresinde ve usulünce yerine getirilmesi kaydı ile, cayma bildiriminin Şirketimize ulaştığı tarihten itibaren 14 gün içinde, Ürün bedeli ve varsa Ürün'ün teslim masrafları, Ürün'ü satın alırken kullandığı ödeme aracına uygun bir şekilde Tüketici'ye iade edilir. Ancak, cayma hakkının sipariş konusu ürünlerin tamamı için kullanıldığı haller ile bir kısmı için kullanıldığı durumlarda (Tüketicinin istifade ettiği) Şirketimiz ücretsiz kargo (teslim) kampanyası ve/veya indirim/iskonto kampanyası (bedelsiz, diğer değişle hediye ürün alabilme de bu anlamdadır, 3 al 2 öde gibi) asgari tutarının altına düşülmesi halinde, ilgili kampanya kapsamında tahsil edilmemiş teslim-kargo bedeli ve uygulanan indirim/iskonto tutarının (keza bedelsiz ürünün bedelinin) tamamı Tüketiciye iade edilecek tutardan mahsup edilerek Tüketici’den alınır (Teslim-kargo ücreti tahsil edilmiş olunan hallerde bunun ücreti mahsup olunmamak sureti ile iade edilir); Tüketici'nin alışverişi neticesinde kazandığı bir (sanal/fiziki) hediye çeki vb. varsa tamamı iptal olunur, kullandığı (sanal/fiziki) hediye çeki vb. varsa bunun tutarının tamamı iade edilecek meblağdan mahsup edilerek geri alınır. Mahsubun yetmediği hallerde Tüketici'nin alışverişindeki ödeme aracından (kredi kartı vb. dahil) tahsilat yapılır.

Bu hükümler, cayma hakkının kullanıldığı hallerin yanı sıra, ayıplı ürünler hariç ürün iadesinin söz konusu olduğu diğer tüm hallerde de aynen tatbik edilir. Şirketimizin, yine kanuna uygun cayma halleri ve diğer sipariş-Sözleşme iptallerinde Tüketici'den, tarafınca Site’de kazanılmış ve/veya Ürün bedeli ödemesinde indirim vb. amaçla kullanılmış her türlü ödül puanı vb.nin parasal değerleri için (de) geçerli tahsil-mahsup hakları dahil akdi ve kanuni hak-yükümlülükleri ayrıca mevcut ve saklıdır.

Sözleşme ve kanuna uygun caymalar dahil sipariş iptallerinde ve Sözleşme fesihlerinde, Ürün bedeli tahsil edilmiş ise, azami 14 gün içinde, Ürün bedelini ödediği araca uygun bir şekilde Tüketici'ye iade edilir. Örneğin kredi kartlı ödemelerde iade işlemi de Tüketici kredi kartına iade sureti ile yapılır ve Ürün tutarı, siparişin Tüketici tarafından iptal edilmesinden sonra aynı sürede ilgili bankaya iade edilir; bu tutarın bankaya iadesi işleminin Satıcı tarafından yapılmasında sonra Tüketici hesaplarına yansıması tamamen banka işlem süreci ile ilgili olduğundan, bu tür insiyatifi dışındaki nedenlerden kaynaklı olası gecikmeler için Satıcı herhangi bir şekilde sorumlu değildir (bankaların iadeyi Tüketici hesabına yansıtma işlemleri üç haftayı bulabilmektedir).

Satıcı'nın Tüketici'ye iade edilecek bedel için, Sözleşme ve kanundan doğan mahsup, indirim ve tenzilat hakları, yetmediği hallerde tahsilat hakkı vardır ve saklıdır. Sözleşme'nin Satıcı'nın edimini ifa etmemesinden ötürü Tüketici tarafından feshedildiği hallere ilişkin Tüketici kanuni hakları da mevcut ve geçerlidir. Tüketici Ürün ve satışla ilgili talep ve şikayetlerini sözlü veya yazılı şekilde Satıcı'ya bildirebilir. Satıcı olarak müşterilerimizin haklı talep-şikayetleri ile her türlü başvurularını karşılamaktan memnuniyet duyarız. Bu şekilde bir çözüme bağlanması mümkün olmadığı takdirde Tüketici dilerse Gümrük ve Ticaret Bakanlığı'nca her yıl belirlenen ve ilan edilen parasal sınırlar dahilinde kendisinin veya Satıcı'nın yerleşim yerindeki (ikametgâhının bulunduğu yerdeki) İl ve İlçe Tüketici Hakem Heyetleri'ne ve sınırları aşan durumlarda Tüketici Mahkemeleri'ne başvurabilir.

GÜNDEM kullanıcının siteyi işbu gizlilik politikalarına veya yasalara aykırı olarak kullandığını tespit ederse veya yetkili mercilerce bu konuda bir tespit veya inceleme talebi gelirse, kullanıcı ile ilgili bilgileri yetkili makamlara bildirmek hakkına sahiptir. Ayrıca benzer bir durumda GÜNDEM gizlilik prensiplerinde öngörülen diğer tedbirleri alma hakkına da sahiptir.

GÜNDEM, gizli bilgileri hizmetlerimizi sunma, pazarlama amacıyla sizinle irtibata geçme, ilginizi çekebilecek ürün ve hizmetleri önermek profilleme, sipariş takibi, istatistiksel çalışmalar, reklam, tanıtım, pazarlama ve sair iletişim faaliyetleri ile sunulan hizmet kalitesinin arttırılması ve site faaliyetlerinin daha iyi şekilde yürütülmesi amacıyla kullanılabilecek ve sadece bu çalışmaların yapılması amacıyla bilginiz dahilinde olan iş ortakları ve tüm GÜNDEM iştirakleri ile de paylaşımına izin vermektedir.

GÜNDEM müşterilerinin kişisel verileri, bu gizlilik politikası ile belirlenen esas ve kapsam haricinde hiçbir şekilde kullanılmayacaktır.

GÜNDEM, kamu güvenliğinden sorumlu resmi makamlarla talepleri halinde gizli bilgileri paylaşma hakkını daima saklı tutar.

Sistemle ilgili sorunların tanımlanması ve Sitede çıkabilecek sorunların ivedilikle giderilebilmesi için, GÜNDEM, gerektiğinde kullanıcıların IP adresini tespit etmekte ve bunu kullanmaktadır. IP adresleri, kullanıcıları genel bir şekilde tanımlamak ve kapsamlı demografik bilgi toplamak amacıyla da kullanılabilir. GÜNDEM dahilinde başka sitelere link verilebilir, yönlendirme yapılabilir. Kişisel Veriler

Müşterilerinin kişisel verileri, GÜNDEM haricinde yalnızca kullanıcı tarafından ulaşılabilir ve bu bilgiler ancak kullanıcı tarafından güncellenebilir. Müşterinin talebi ile kişisel veriler GÜNDEM tarafından da güncellenebilecektir.

GÜNDEM, kullanıcılarına daha iyi hizmet verebilmek, ürünlerini ve hizmetlerini geliştirmek, internet sitesinin kullanımını kolaylaştırmak ve kullanıcıların özel tercihlerine ve ilgi alanlarına yönelik çalışmalar ve gösterimler yapmak amacıyla internet sitesini kullanırken kullanıcılardan bazı kişisel verilerin (adınız, soyadınız, doğum tarihiniz, yaşınız, cinsiyetiniz, medeni durumunuz, ilgi alanlarınız, e-posta adresiniz, telefon numaranız vb.) verilmesini talep etmekte ve kişisel verilerinizi bu amaç doğrultusunda toplamakta, işlemekte ve kullanmaktadır. Kullanıcılar, Kişisel Verilerin Korunması Kanunu uyarınca:

e)  kişisel verilerinizin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme;

f)   kişisel verilerinizin işlenmesini gerektiren sebeplerin ortadan kalkması halinde kişisel verilerinizin silinmesini veya yok edilmesini isteme;

g)  kişisel Verilerin Korunması Hakkında Kanun Madde 7 uyarınca yukarıda bahsedilen düzeltme, silme veya yok etme işlemlerinin, kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme;

h)  işlenen verilerinizin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme; ve

i)   kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararınızın giderilmesini talep etme haklarına sahiptir.

Lütfen kişisel verilerinizin düzeltilmesi, bloke edilmesi veya silinmesine yönelik başvuruları veya verilerin korunmasına ilişkin her türlü soruyu doğrudan site yönetimine bildiriniz.

Çerezler

Farklı internet siteleri üzerinde sitemizin trafiğini arttırmak adına çerezler (bir karakter dizisi içeren küçük bir dosya) kullanmaktayız. Ancak bununla beraber kötü niyetli kullanıcıların sunmuş oldukları yazılım ve önlenemeyen datalar ya da kendi hatalarınızdan dolayı bilgisayarınızda var olan virüs ve/veya Truva atı gibi programlar dolayısıyla, sunduğumuz çerezler dolayısıyla herhangi bir şekilde sorumluluğumuz bulunmamaktadır. Ancak, kullanıcılar dilerlerse çerez dosyasının gelmemesi veya çerez dosyası gönderildiğinde ikaz verilmesini sağlayacak biçimde tarayıcı ayarlarını değiştirebilirler. Hizmet Şartları

1. Çankaya Mah. Üsküp Cad. No: 8/2 Çankaya Ankara adresinde faaliyet gösteren GÜNDEM (Şerif Uğur Çınar) Hitit V.D. 2510396105 bu sözleşmede GÜNDEM olarak anılacaktır.
2. Aşağıdaki hak ve yükümlülükler tüm kullanıcılar için geçerlidir.
3. Sipariş verirken talep edilen ad, soyad, telefon v.s. bilgileri tam ve doğru girilmelidir. Bu bilgilerin eksik veya hatalı olduğu veya doğru olmadığı durumlarda meydana gelecek aksaklıklardan GÜNDEM sorumlu değildir.
4. Şirket, GÜNDEM'in güvenliğini tehdit edecek, sistemin çalışmasını engelleyecek ya da aksatacak yazılımların kullanılması, teşebbüslerin yapılması ya da yapılmaya çalışılması yasaktır.
5. Kullanıcı, verdiği bilgilerin doğruluğunu onaylar ve bu bilgilerin yanlış olmasından kaynaklanacak her türlü sonucu peşinen kabul eder. GÜNDEM, kullanıcıların verdiği bilgilerin doğru olup olmadığını kontrol ve teyit etmemektedir ve bu konuda sorumluluk kabul etmemektedir.
6. GÜNDEM'de bulunan bütün yazılı, resimli, grafik içeren veya içermeyen tüm materyallerin her hakkı saklıdır. Bu materyalleri kopyalayarak kişisel sayfalarda yayınlamak ve/veya pazarlamak kesinlikle yasaktır. Kişisel sayfalarda bu gibi materyallerin kullanılması halinde mutlaka kimden alıntı yapıldığı ve/veya alıntı yapılan şahıs ve ticari kurumun izin verdiğini belirten bir ibarenin sayfanın altına eklenmesi zorunludur. Aksi halde doğabilecek kanuni ihtilaflarda GÜNDEM hiçbir sorumluluk kabul etmez.
7. GÜNDEM kendi kontrolü altında olmayan başka internet sitelerine bağlantı veya referans içerebilir. GÜNDEM, bu internet sitelerin içerikleri veya içerdikleri diğer bağlantılardan sorumlu değildir.
8. Sistemde çerez (cookie/tanımlama bilgileri) kullanıldığını, çerezlerin bir internet sitesinin kullanıcının bilgisayarındaki sabit diskte çerez dosyasına aktardığı bilgi parçaları olduğunu, bunların kullanıcıların siteyi gezinmesine olanak sağladığını ve gerektiğinde siteye erişen kullanıcıların ihtiyaçlarına uygun içeriklerin hazırlanmasına yardımcı olmaktadır.
9. GÜNDEM’in kullanımı sırasında kaybolacak ve/veya eksik alınacak, yanlış adrese iletilecek bilgi, mesaj ve dosyalardan veya gönderilerden GÜNDEM sorumlu değildir.
10. Online yapılan ödemelerde, kartın hamili haricinde bir başkası tarafından hukuka aykırı şekilde kullanılması halinde 23.02.2006 tarihli 5464 sayılı Banka Kartları ve Kredi Kartları Kanunu ve 10.03.2007 tarihli ve 26458 sayılı Resmi Gazete’de yayımlanan Banka Kartları ve Kredi Kartları Hakkında Yönetmelik hükümlerine göre işlem yapılır.
11. GÜNDEM'de yer alan bilgiler, fotoğraflar, linkler kopyalanarak başka bir ürün veya hizmet için kullanılamaz.
12. GÜNDEM, mekanik, elektronik veya iletişimsel arıza veya bozulma gibi kendi inisiyatifi dışında gerçekleşen nedenlerden kaynaklanan hatalar yüzünden, bu sözleşmede belirtilen yükümlülüklerini yerine getirememekten sorumlu değildir.
13. Bu sözleşmenin herhangi bir hükmü uygulanamaz veya geçersiz addedilirse, bu geçersizlik sadece bu durum ile sınırlandırılır ve sözleşmenin geri kalan kısmı tamamen geçerliliğini korur.
14. Bu sözleşme, hukuki ihtilaflar ayırt edilmeksizin, Türkiye Cumhuriyeti kanunları çerçevesinde yorumlanır ve İstanbul Mahkemeleri bu sözleşmenin uygulanmasında yetkilidir.
15. GÜNDEM'yi kullanmak isteyen ziyaretçiler yukarıda belirtilen maddelerdeki şartları peşinen kabul etmiş sayılır.
16. Kullanıcıların yukarıdaki koşullara uymamasından dolayı kendilerine veya diğer kullanıcılara gelebilecek zararlardan Şirket sorumlu değildir.
17. GÜNDEM, indirim ve kampanya koşullarında önceden herhangi bir haber vermeye gerek duyulmadan değişiklik yapma hakkına sahiptir.
18. GÜNDEM, önceden herhangi bir haber vermeye gerek duyulmadan yukarıda belirtilen maddelerde istediği değişiklikleri yapma hakkına sahiptir.

Site’den sipariş konusu mal/hizmetlerin (Ürün/Ürünler) siz değerli Müşterimiz (Tüketici-Alıcı) tarafından satın alınması ve böylece sipariş-Sözleşme'nin yapılması ile ilgili teknik aşama ve adımlar buraya kadarki işlemleriniz sırasında ilgili sayfalarda belirtilmiştir. Site’den vereceğiniz siparişinizle ilgili bir veri girişinde hata söz konusu ise ilgili uyarı mesajı doğrultusunda işlem ile düzelterek devam edilebileceksiniz. Aynı şekilde ödeme bilgilerinizi girerken oluşabilecek hataları da gidermeniz mümkündür. Ödeme işleminin tamamlanmasından sonra fark ettiğiniz bilgi girişi hatası olursa müşteri hizmetlerimizle 0530 789 1679 numaralı telefon ile irtibata geçebilirsiniz. Teslimatlarımızı anlaşmalı olduğumuz Yurtiçi Kargo firması ile yapmaktayız. Tüketici Sözleşme'yi onayladığında, sipariş verdiği Ürün(ler)'in bu sayfada belirtilen bedeli ve masrafları seçtiği ödeme yöntemi ile tarafından tahsil olunur. 

Tüketici'nin Ürün'ü teslim aldığı tarihten itibaren 14 gün içinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin siparişten ve Sözleşme'den cayma hakkı vardır. Ancak şu mal/hizmetlere ilişkin sözleşmelerde, kullanılmamış/istifade edilmemiş olsalar dahi, kanunen cayma hakkı yoktur:   

a) Tüketici'nin özel istekleri veya onun kişisel ihtiyaçları doğrultusunda hazırlanan mallar (üzerinde değişiklik/ilaveler yapılarak kişiye/kişisel ihtiyaçlara özel hale getirilenler, Alıcı siparişine istinaden yurt içinden veya dışından ithal/temin edilen özel Ürünler dahil) 

b) Kozmetik vb.leri ile çikolata vb. gıda maddeleri gibi çabuk bozulabilen veya son kullanma tarihi geçebilecek mallar 

c) Kozmetik, mayo, iç giyim mamülleri vb. teslimden sonra ambalaj, bant, mühür, paket gibi koruyucu unsurları açılmış ve iadesi sağlık-hijyen açısından uygun olmayan mallar 

d) Genel olarak ilgili mevzuat uyarınca mesafeli satış kapsamı dışında kabul edilen diğer mal-hizmetler 

e) Alıcı'nın ticari/mesleki amaçla satın alma yaptığı haller. 

Kanunen cayma hakkı olan hallerde, cayma süresi içinde mal, işleyişine, teknik özelliklerine ve kullanım talimatlarına uygun bir şekilde kullanılmadığı için meydana gelen değişiklik ve bozulmalardan kanun gereği Tüketici sorumlu olup bu sebeple Ürün'e ilişkin cayma hakkını kaybedebileceği gibi, ihtiyaren kabul ettiğimiz takdirde Ürün bedelinden değişiklik / bozulma kadar indirim yapmak hakkımız vardır. Cayma halinde ilgili Ürün'ün en geç yasal süresi içerisinde geri gönderilmesi zorunludur; anlaşmalı kargo firmamız olan Yurtiçi Kargo’nun şubesinden tarafımıza ücretsiz bir şekilde gönderilmesi gerekmektedir ve mümkündür. Cayma hususundaki açık bildirim yukarıdaki iletişim adreslerimize, mektup, elektronik posta, telefon gibi araçlar ile yapılabilir. Bu hakkın kullanılması halinde, anılan bildirimin yanı sıra Ürün'ün tarafımıza gönderildiğine ilişkin kargo teslim tutanağı örneği ile (vergi mevzuatı uyarınca) irsaliye/fatura aslının iadesi, faturası kurumlar adına düzenlenen Ürün iadelerinde iade faturası kesilmesi, ayrıca iade edilecek Ürün'lerin kutusu, ambalajı, varsa standart aksesuarları ile birlikte eksiksiz ve hasarsız olarak tarafımıza iletilmesi gerekmektedir. Kanunen cayma hakkı öngörülmemiş hallerde cayma hakkından faydalanılamayacağı gibi bu hakkın usulüne uygun veya zamanında kullanılmadığı durumlarda Tüketici cayma hakkını kaybeder. Yukarıda belirtilen gereklerin Tüketici tarafından süresinde ve usulünce yerine getirilmesi kaydı ile, cayma bildiriminin Şirketimize ulaştığı tarihten itibaren 14 gün içinde, Ürün bedeli ve varsa Ürün'ün teslim masrafları, Ürün'ü satın alırken kullandığı ödeme aracına uygun bir şekilde Tüketici'ye iade edilir. Ancak, cayma hakkının sipariş konusu ürünlerin tamamı için kullanıldığı haller ile bir kısmı için kullanıldığı durumlarda (Tüketicinin istifade ettiği) Şirketimiz ücretsiz kargo (teslim) kampanyası ve/veya indirim/iskonto kampanyası (bedelsiz, diğer deyişle hediye ürün alabilme de bu anlamdadır, 3 al 2 öde gibi) asgari tutarının altına düşülmesi halinde, ilgili kampanya kapsamında tahsil edilmemiş teslim-kargo bedeli ve uygulanan indirim/iskonto tutarının (keza bedelsiz ürünün bedelinin) tamamı Tüketiciye iade edilecek tutardan mahsup edilerek Tüketici’den alınır (Teslim-kargo ücreti tahsil edilmiş olunan hallerde bunun ücreti mahsup olunmamak sureti ile iade edilir); Tüketici'nin alışverişi neticesinde kazandığı bir (sanal/fiziki) hediye çeki vb. varsa tamamı iptal olunur, kullandığı (sanal/fiziki) hediye çeki vb. varsa bunun tutarının tamamı iade edilecek meblağdan mahsup edilerek geri alınır. Mahsubun yetmediği hallerde Tüketici'nin alışverişindeki ödeme aracından (kredi kartı vb. dahil) tahsilat yapılır. 

Bu hükümler, cayma hakkının kullanıldığı hallerin yanı sıra, ayıplı ürünler hariç ürün iadesinin söz konusu olduğu diğer tüm hallerde de aynen tatbik edilir. Şirketimizin, yine kanuna uygun cayma halleri ve diğer sipariş-Sözleşme iptallerinde Tüketici'den, tarafınca Site’de kazanılmış ve/veya Ürün bedeli ödemesinde indirim vb. amaçla kullanılmış her türlü ödül puanı vb.nin parasal değerleri için (de) geçerli tahsil-mahsup hakları dahil akdi ve kanuni hak-yükümlülükleri ayrıca mevcut ve saklıdır. 

Site’de işlem güvenliği, bilgilerin korunması, gizliliği, işlenmesi-kullanımı ve ticari elektronik iletişimler ile ilgili hususlarda Satıcı ve Tüketici için geçerli cari kurallar-şartlar aşağıda bilginize sunulmuştur. Tüketici dilediği her zaman bu konularda belirtilen iletişim araçları ile Şirketimize ulaşarak danışabilir. 

Yukarıda-aşağıda yer alan bilgilendirmeler ile Sözleşme'yi Site’de onaylayarak kabulünüzden sonra tüm bunları cihazına kaydedip saklayarak her zaman erişebileceğiniz gibi, ilgili yasalar çerçevesinde ve azami üç yıl süre ile Şirketimiz nezdindeki sistemlerde muhafaza edileceklerdir.

Sipariş konusu Ürün, yasal 30 günlük süre aşılmamak koşulu ile Tüketici'ye/bildirdiği yukarıdaki adresteki üçüncü kişi/kuruluşa aşağıda belirtilen esaslarda teslim edilir. Stoklarda olan Ürünler, sipariş tarihinden itibaren, yasal süre içerisinde Tüketici tarafından sipariş esnasında bildirilen kişi ve adrese teslim edilmek üzere kargo firmasına teslim edilir. Kargo Firmaları, Satıcı’dan teslim aldığı gönderileri, uzaklıklarına göre değişmekle birlikte normal şartlar altında ortalama 3 (üç) iş günü içerisinde Alıcı’lara ulaştırmaktadır. Genel olarak ve aksi açıkça belirtilmediği sürece teslimat masrafları (kargo ücreti vb.) Tüketici'ye aittir. Satıcı, satış anında yürüttüğü ve Site’de şartlarını ilan ettiği kampanyalara bağlı olarak söz konusu teslimat masraflarının tamamını ya da bir kısmını Tüketici'ye yansıtmayabilir. Ürünlerin teslimatı anında Tüketici'nin adresinde bizatihi bulunmaması ve adresteki kişilerin teslimatı kabul etmemesi durumunda Satıcı, bu husustaki edimini yerine getirmiş kabul edilecektir. Adreste teslim alacak bir kimsenin olmaması durumunda kargo firması ile temas kurarak ürünlerin sevkiyatını takip ve temin etmek Tüketici'nin sorumluluğundadır. Ürün, Tüketici'den başka bir kişi/kuruluşa teslim edilecek ise, bu kişi/kuruluşun adresinde bulunmaması veya teslimatı kabul etmemesinden Satıcı sorumlu tutulamaz. Bu hallerde Tüketici'nin Ürün'ü geç teslim almasından kaynaklanan her türlü zarar ile Ürün'ün kargo şirketinde beklemiş olması ve/veya kargonun Satıcı'ya iade edilmesinden dolayı oluşan giderler de Tüketici'ye aittir. 

Ürün'ü teslim alacak her kişi, teslim aldığı anda kontrol etmekle ve Ürün'de kargodan kaynaklanan bir sorun gördüğünde Ürün'ü kabul etmemekle ve kargo firması yetkilisine tutanak tutturmakla sorumludur. Aksi halde Satıcı herhangi bir mesuliyet kabul etmeyecektir. Tüketici'nin Ürün'ü teslim almadan önce masraflar dahil satış bedelini tamamen ödemiş olması gerekir. Peşin satışlarda teslimattan önce Ürün bedeli Satıcı'ya tamamen ödenmediği, taksitli satışlarda vadesi gelen taksit tutarı tediye edilmediği takdirde Satıcı, tek taraflı olarak sözleşmeyi iptal edebilir ve Ürün'ü teslim etmeyebilir. Ürün teslimatı sonrasında herhangi bir sebepten dolayı, işlem yapılan kredi kartının ait olduğu Banka/finansman kurumunun Ürün bedelini Satıcı'ya ödememesi yada ödediği bedeli geri talep etmesi halinde, Ürün en geç 3 gün içinde Tüketici tarafından Satıcı'ya iade edilir. Ürün bedelinin ödenmemesi Tüketici’nin Banka'ya haksız bir talimatından veya itirazından yahut bir kusurundan veya ihmalinden kaynaklanıyor ise kargo masrafları Tüketici tarafından karşılanacaktır. Satıcı'nın iadeyi kabul etmeksizin Ürün bedeli alacağını takip dahil diğer tüm akdi-kanuni hakları ayrıca ve her halükarda saklıdır. Tereddüte mahal vermemek bakımından; Tüketici'nin satış bedelini, bankalardan (finansman kuruluşları dahil) sahip olduğu kredi kartı, taksit kart vb. ile ödediği hallerde, bu kartların tanıdığı tüm imkanlar doğrudan kartı veren kuruluşça sağlanmış kredi ve/veya taksitli ödeme imkanlarıdır; bu çerçevede gerçekleşen ve Satıcı'nın bedelini defaten veya peyder pey tahsil ettiği Ürün satışları işbu Sözleşme’nin tarafları yönünden kredili veya taksitli satış değildir, peşin satıştır. Satıcı'nın kanunen taksitle satış sayılan hallerdeki yasal hakları (taksitlerin ödenmemesi halinde sözleşmeyi fesih ve/veya kalan borcun tümünün temerrüt faizi ile birlikte ödenmesini talep hakları dahil) ilgili mevuzat çerçevesinde mevcut ve saklıdır. Tüketici'nin temerrüdü durumunda yürürlükteki kanunların öngördüğü şekilde aylık oranda temerrüt faizi tatbik edilir. Ürün'ün yasal azami süre olan 30 gün içinde Tüketici'ye teslimi, zamanında teslimdir. Normal satış/teslimat koşulları dışındaki olağanüstü durumlar (hava muhalefeti, yoğun trafik, deprem, sel, yangın gibi) nedeni ile yasal azami 30 günlük süre zarfında teslim edilememesi söz konusu ise, Satıcı teslimat ile ilgili olarak Tüketici'yi mevcut iletişim bilgilerinden ulaşarak haberdar eder. Bu durumda Tüketici siparişi iptal edebilir, benzer bir ürün sipariş edebilir veya olağanüstü durum sona erene kadar bekleyebilir. Satıcı Sözleşme konusu Ürün'ü tedarik edilemeyeceğinin anlaşılması halinde, bu durumu öğrendiği tarihten itibaren üç (3) gün içinde Tüketici'yi açık biçimde ve aynı araçlardan biri ile bilgilendirerek sözlü/yazılı onayını almak kaydıyla, eşit kalite-fiyatta başka bir mal/hizmeti tedarik edebilir ve Sözleşme konusu taahhüdünü bu suretle yerine getirmiş sayılır. Tüketici söz konusu onayı verip vermemekte her bakımdan serbesttir ve onay vermediği hallerde sipariş iptaline (Sözleşme feshine) ilişkin akdi-kanuni hükümler uygulanır.

Site’de Tüketici tarafından girilen bilgilerin ve işlemlerin güvenliği için gerekli önlemler, Satıcı tarafındaki kendi sistem alt yapısında, bilgi ve işlemin mahiyetine göre günümüz teknik imkanları ölçüsünde alınmıştır. Bununla beraber, söz konusu bilgiler Tüketici cihazından girildiğinden Tüketici tarafında korunmaları ve ilgisiz kişilerce erişilememesi için, virüs ve benzeri zararlı uygulamalara ilişkin olanlar dahil, gerekli tedbirlerin alınması sorumluluğu Tüketici'ye aittir. Site’den ulaşılan diğer sitelerde kendilerine ait gizlilik-güvenlik politikaları ve kullanım şartları geçerlidir, oluşabilecek ihtilaflar ile menfi neticelerinden Satıcı sorumlu değildir.

Sözleşme ve kanuna uygun caymalar dahil sipariş iptallerinde ve Sözleşme fesihlerinde, Ürün bedeli tahsil edilmiş ise, azami 14 gün içinde, Ürün bedelini ödediği araca uygun bir şekilde Tüketici'ye iade edilir. Örneğin kredi kartlı ödemelerde iade işlemi de Tüketici kredi kartına iade sureti ile yapılır ve Ürün tutarı, siparişin Tüketici tarafından iptal edilmesinden sonra aynı sürede ilgili bankaya iade edilir; bu tutarın bankaya iadesi işleminin Satıcı tarafından yapılmasında sonra Tüketici hesaplarına yansıması tamamen banka işlem süreci ile ilgili olduğundan, bu tür inisiyatifi dışındaki nedenlerden kaynaklı olası gecikmeler için Satıcı herhangi bir şekilde sorumlu değildir (bankaların iadeyi Tüketici hesabına yansıtma işlemleri üç haftayı bulabilmektedir). 

Satıcı'nın Tüketici'ye iade edilecek bedel için, Sözleşme ve kanundan doğan mahsup, indirim ve tenzilat hakları, yetmediği hallerde tahsilat hakkı vardır ve saklıdır. Sözleşme'nin Satıcı'nın edimini ifa etmemesinden ötürü Tüketici tarafından feshedildiği hallere ilişkin Tüketici kanuni hakları da mevcut ve geçerlidir. Tüketici Ürün ve satışla ilgili talep ve şikayetlerini, yukarıda belirtilmiş iletişim kanallarından ulaşarak, sözlü veya yazılı şekilde Satıcı'ya bildirebilir.

Satıcı olarak müşterilerimizin haklı talep-şikayetleri ile her türlü başvurularını karşılamaktan memnuniyet duyarız. Bu şekilde bir çözüme bağlanması mümkün olmadığı takdirde Tüketici dilerse Gümrük ve Ticaret Bakanlığı'nca her yıl belirlenen ve ilan edilen parasal sınırlar dahilinde kendisinin veya Satıcı'nın yerleşim yerindeki (ikametgâhının bulunduğu yerdeki) İl ve İlçe Tüketici Hakem Heyetleri'ne ve sınırları aşan durumlarda Tüketici Mahkemelerine başvurabilir.

Tüketici, onayı halinde Mesafeli Satış Sözleşmesi'nin ayrılmaz bir parçasını oluşturacak işbu Ön Bilgilendirmeler ile, satışa konu Ürün/Ürün'lerin temel özellik-nitelikleri, satış fiyatı, ödeme şekli, teslimat işlemleri ve cayma hakkı dahil tüm hususlarda bilgilendirilmiş bulunmaktadır.

İş bu Sipariş-Sözleşme Ön Bilgilendirmelerindeki tüm açıklamalar ve bilgiler Tüketici'nin Site’de onayladığı an itibariyle geçerli olup kabulü halinde Satıcı ve Tüketici (Alıcı) arasında Mesafeli Satış Sözleşmesi ile birlikte bağlayıcı olarak uygulanır.
